Eligibility

By using Povnd, you confirm that:

• You are at least 13 years old
• You have authority to enter this agreement
• Information provided is accurate and current
• You will comply with all applicable laws and regulations

Services Provided

Povnd may provide services including but not limited to:

• Music distribution support
• Music promotion and marketing
• Artist dashboard management
• Playlist campaigns
• Pre-save campaigns
• Digital release management
• Promotional tools
• Analytics and engagement tracking

Services may be modified, updated, suspended, or discontinued at any time without prior notice.

User Accounts

Users are responsible for maintaining account confidentiality, securing login credentials, all activities conducted through their accounts, and providing accurate and updated information. Povnd reserves the right to suspend or terminate accounts involved in fraudulent, abusive, or unauthorized activity.

Content Ownership & Licensing

Users retain ownership of their original music and uploaded content. By uploading content to Povnd, users grant Povnd an exclusive worldwide license to host, publish, promote, encode, display, distribute, and market content through Povnd services and connected platforms.

Users represent and warrant that they own or control all necessary rights, that submitted content does not infringe copyrights or trademarks, and that content complies with applicable laws.

Distribution Limitations

Povnd may facilitate delivery of content to third-party streaming platforms and digital stores. However, Povnd does not guarantee:

• Editorial playlist placements
• Platform approvals
• Revenue outcomes or specific streaming performance
• Release timelines
• Availability on every platform

Third-party DSPs maintain independent moderation and approval processes.

Payments & Refunds

Certain services may require payment. Users agree that:

• Pricing may change without prior notice
• Payments are generally non-refundable
• Fraudulent payment disputes may result in account suspension
• Taxes and processing fees may apply

Povnd reserves the right to withhold services until outstanding obligations are resolved.

Prohibited Activities

Users may not:

• Upload copyrighted material without authorization
• Manipulate streams or platform analytics
• Use bots or automated abuse systems
• Upload malicious files or harmful software
• Harass or abuse other users
• Attempt unauthorized access to systems
• Misrepresent ownership of content
• Engage in illegal or fraudulent activity

Copyright Complaints & Takedowns

Povnd respects intellectual property rights. Where valid infringement claims are received, Povnd may remove content, suspend releases, restrict account access, and cooperate with rights holders or authorities. Repeat infringement may result in permanent account termination.

Third-Party Platforms

Povnd integrates with third-party services including streaming platforms, payment processors, analytics systems, and social media services. Povnd is not responsible for platform outages, DSP moderation decisions, revenue delays, third-party policy changes, or removal of content by external services.

Disclaimer of Warranties

Povnd services are provided "as is" and "as available." We make no guarantees regarding continuous or uninterrupted operation, error-free functionality, revenue generation, distribution approvals, platform compatibility, or promotional performance. Use of the platform is at the user's own risk.

Limitation of Liability

To the fullest extent permitted by law, Povnd shall not be liable for indirect damages, loss of profits or revenue, data loss, reputation damage, distribution delays, third-party platform actions, or technical interruptions or outages.

Indemnification

Users agree to indemnify and hold harmless Povnd, its affiliates, partners, and team members from claims, liabilities, damages, or expenses arising from user content, copyright disputes, violation of these Terms, misuse of the platform, or illegal activities.

Intellectual Property

All Povnd branding, graphics, logos, software, interfaces, and website materials remain the exclusive property of Povnd unless otherwise stated. Unauthorized use is prohibited.

Changes to Terms

Povnd reserves the right to revise these Terms at any time. Updated Terms become effective immediately upon posting to the platform. Continued use of Povnd constitutes acceptance of revised Terms.

Governing Law

These Terms shall be governed in accordance with applicable laws and regulations in the jurisdiction where Povnd operates.
